In our latest Data Protection Index Report we asked participating data privacy professionals whether they think the political agreement between the EU and the US announced on 25th March 2022, which proposed a new Trans-Atlantic Data Privacy Framework, would make it to a legal agreement. Interestingly, 64% of those surveyed said they believe it would.
However despite the optimism around it becoming a legal agreement, there is less enthusiasm around whether it would survive a legal challenge. With most DPOs scoring it a five out of 10, sitting on the fence, but only one in ten stating that it would likely survive. Paul, DPO, pointed out that “Despite pressure from EU privacy professionals for certainty around EU-US transfers, Mr Schrems has indicated his intention to challenge the new legal arrangement. Even if it becomes law, I don’t believe that we will be able to wholly rely on it for the foreseeable future”. Suggesting that there is a degree of “wishful thinking”.
