ICO publishes data protection and journalism code of practice
On 1 February 2024, the UK’s Information Commissioner’s Office (ICO) published an important code of practice for the journalistic use of personal information. The code mostly applies to media organisations, journalists, and broadcasters, but also to anyone using personal information in any form of publication, including blogs and social media.
The code aims to balance freedom of expression with an individual’s right to privacy and data protection. As data protection law does not define journalism, the ICO highlights that the legislation should be interpreted broadly, using case law as a guide, where appropriate. ICO’s 2nd edition Tech Horizons Report
On 7 February 2024, the UK’s Information Commissioner’s Office (ICO) announced on LinkedIn its second annual Tech Horizons Report. Due to continuing rapid technological developments, this edition considers a further 8 technologies that the ICO believes may have a significant impact on societies, economies, and information rights in the next 2-7 years. These include genomics, immersive virtual worlds, neurotechnologies, quantum computing, commercial drones, personalised AI, next generation search, and Central Bank Digital Currencies (CBDCs).
These technologies could improve our health, social interactions, and the way in which we do business. However, the ICO highlights the importance of ensuring organisations continue to build ‘data protection by design’ into their innovations.
Ireland’s new Data Protection Commissioners announced
Ireland’s Justice Minister Helen McEntee has announced the appointment of two new Data Protection Commissioners, Dr Des Hogan and Mr Dale Sunderland, effective 20 February 2024. The appointments follow a review by the Department of Justice to support the Data Protection Commission’s (DPC) growth, with the government deciding on two additional commissioners. The vacancy for the third will be filled as soon as possible.
The budget for the Commission this year is €28.1m, an almost 8-fold increase on the 2015 budget, and underscores the DPC’s commitment to strengthening data regulations and safeguarding individuals' rights.
EU and US enhance cooperation on cybersecurity
Thierry Breton, European Commissioner for Internal Market, visited Washington DC at the end of January 2024 to discuss the EU-US Joint Cyber Safe Products Action Plan. The plan outlines the steps for further collaboration between the Commission and US regulatory agencies in cybersecurity requirements for the Internet-of-Things (IoT) hardware and software consumer products. The Administrative Arrangement is intended to enhance transparency and protection for consumers and reduce the compliance burden for businesses.
Biden-Harris announce first ever consortium dedicated to AI safety
On 8 February 2024, US Secretary of Commerce Gina Raimondo announced the creation of the AI Safety Institute Consortium (AISIC). This will unite AI creators, users, academics, government and industry researchers, and civil society organisations in support of the safe and trustworthy development of AI technologies. The Consortium will contribute to the priority actions outlined in President Biden’s Executive Order for the advancement of AI.
The AISIC will share best practices and promote research into AI safety and ethics, providing a platform for dialogue and cooperation between various stakeholders in the AI sphere. This represents a significant step forward as authorities across the globe consider the parameters of using AI as a tool for progress whilst mitigating potential risks. Read the full press release
US Senator calls for stricter privacy regulations for data brokerage industry
Senator Ron Wyden has written to the Federal Trade Commission and the Securities and Exchange Commission requesting an investigation into the data provider, Near Intelligence. He claims the company sold information about people’s visits to around 600 Planned Parenthood clinics for a large anti-abortion ad campaign. He calls for privacy regulations to curb the practices of the data brokerage industry.
Justin Sherman, a data broker researcher at Duke University, said, ‘This is the largest targeting campaign we’ve seen to date against reproductive health clinics based on brokered data.’
Singapore proposes Governance Framework for generative AI
On 16 January 2024, Singapore’s Infocomm Media Development Authority (IMDA) and the AI Verify Foundation announced a public consultation on their draft Model AI Governance Framework for Generative AI (Draft GenAI Governance Framework). This is the latest in a series of initiatives by Singapore and aims to address generative AI concerns whilst supporting innovation. The framework identifies 9 key areas, including accountability, data, testing and assurance, and safety. The document is intended as a discussion piece rather than offering specific guidance for organisations.
With the upcoming EU’s AI Act, Singapore is among many countries across the globe discussing how best to handle the associated data protection risks and challenges of generative AI.
